These following terms and conditions (the “Terms and Conditions”) apply to site users, as well as Customers and Services Providers in the Services Marketplace.
Nothing in these Terms and Conditions shall be construed to place the Koncierge Services Corp. (Koncierge Services) or marketplace participants in the relationship of partners, joint venturers, principal\agent, or employer\employee.
Definitions and Interpretation
In these Terms and Conditions, the following words and expressions have the following meanings:
“Site”: means konciergeservices.com, the core component of the broader Services Marketplace.
Client: a person who requests in-home care services by contacting Koncierge Services.
Service Provider(s): and/or “Care Provider(s)”: the individual providing Services to the Client as an independent contractor.
the “Services” or “Home Care Services”: the Home Care Services provided by the Service Provider to a Client as an independent contractor and matching services provided by Koncierge Services to the client looking for In-Home Care Services.
Fees and Subscriptions: as explained in Payment’s section of this document.
Intellectual Property
All content published and made available on our Site is the property of Koncierge Can Services Corp. and/or the independent Services Provider. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.
Sale of Services
These Terms and Conditions apply to all the Services that are displayed on our Site at the time you access it. All information, descriptions, or images that we provide about the Services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all Services provided.
We reserve the right to modify, reject or cancel Client’s order whenever it becomes necessary. If we cancel the order and have already processed the payment, we will give Client a refund equal to the amount paid. The Client agrees that it is their responsibility to monitor their payment instrument to verify receipt of any refund.
Third Party Goods and Services
Our Site is offering Services from third parties. We cannot guarantee the quality or accuracy of Services made available by third parties on our Site.
Payments
1. Connection Fee
The fee for our in-home care services provided by Koncierge Services is either $94 (plus GST) one time connection fee or a 10% charge added to each invoice. By subscribing to our Services, the Client explicitly acknowledges and agrees to these Terms and Conditions. Please note that the Company retains the right to modify or waive the fee at its sole discretion.
2. Client Payments
We accept the following payment methods:
· Automated Invoice Payment,
· E-Transfer,
· Cheque.
When the Client provides us with their payment information, the Client authorizes our use of and access to the payment instrument they have chosen to use.
If we believe the payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse the transaction.
Service Providers and Care Providers are not employees of Koncierge Can Services Corp.
Konciergeservices.com makes no representation or warranty to the Client, which the Client hereby acknowledges, that the Product will achieve intended or desired results. All express and implied representations, terms, conditions, and warranties, whether based on statute or custom of trade or arising in any other manner whatsoever, are excluded from this Agreement.
RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY
Koncierge Can Services Corp. and our directors, officers, agents, employees, independent contractors, and affiliates (here after referred to as “the Releasees”) will not be liable for any actions, claims, losses, damages, liabilities, and expenses including legal fees that might arise through participation in our Services Marketplace, or due to your violation of these Terms and Conditions.
In consideration for use of our Services Marketplace, you agree to:
(1) to waive any and all claims that you have or may have in the future against the Releasees, and to release them from any and all liability for any loss, damage, expenses or injury that you may suffer, or that your next of kin might suffer, resulting from use of this Service Marketplace due to any cause whatsoever, including negligence on the part of the Releasees.
(2) to hold harmless and indemnify the Releasees from any and all liability from any damage to property or of personal injury toa third party resulting from use of the Services Marketplaces.
(3) that this agreement will be effective and binding on your heirs, kin, agents and assigns.
Applicable Law
These Terms and Conditions are governed by the laws of the Province of British Columbia.
Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
Changes
These Terms and Conditions may be amended from time to time to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
